Amateur Athletic Waiver and Release of Liability

In consideration of being allowed to participate in any way in Ormond Beach Youth Baseball & Softball Association (OBYBSA) athletic sports program, related events, and activities, the registrant acknowledges, appreciates, and agrees that the risks of injury and illness, including communicable diseases, from the activities involved in this program are significant and potentially life-threatening.

The registrant knowingly and freely assumes all such risks, both known and unknown, even if arising from the negligence of the releasees or others, and assumes full responsibility for participation.

The registrant willingly agrees to comply with the stated and customary terms and conditions for participation. If any unusual or significant hazard is observed during participation, the participant and/or child will be removed from participation and the nearest official will be notified immediately.

The registrant further acknowledges awareness of risks arising from outbreaks of communicable disease, including but not limited to Coronavirus Disease (COVID-19) and any mutation or variation thereof.

In consideration of the opportunity to participate as either a team member or spectator, and in acknowledging awareness of and willingness to assume the associated risks, the registrant voluntarily agrees to waive, hold harmless, and indemnify OBYBSA, Babe Ruth League, Inc., and its trustees, agents, volunteers, and employees from any and all claims, demands, damages, and causes of action arising out of ordinary negligence connected to participation.

I have read this release of liability and assumption of risk agreement, fully understand its terms, understand that substantial rights are given up by agreeing to it, and agree to it freely and voluntarily without any inducement.

For Participants of Minority Age

This is to certify that I, as parent or guardian with legal responsibility for this participant, have read and explained the provisions in this waiver and release to my child or ward, including the risks of the activity and his or her responsibilities for adhering to the rules and regulations.

Furthermore, my child or ward understands and accepts these risks and responsibilities. I, for myself, my spouse, and child or ward, consent to the release provided above for all releasees and agree to indemnify and hold harmless the releasees from any and all liabilities incident to my minor child’s or ward’s involvement or participation in these activities, even if arising from their negligence, to the fullest extent permitted by law.

City of Ormond Beach Release and Waiver of Liability

Each of the undersigned, individually and on behalf of the participant, understands, agrees, and acknowledges that participation in the recreation program could result in bodily injury, death, and/or property damage.

Each of the undersigned assumes full responsibility for and risk of bodily injury, death, and/or property damage due to the negligence of the City and agrees not to make any claim, suit, action, or other demand for damages against the City for any bodily injury, death, and/or property damage resulting, in whole or in part, from the negligence of the City, whether occurring before or after the date of signing.

The foregoing release and waiver of liability is intended to be as broad and inclusive as permitted by law. If any part is held invalid, the remainder shall remain in full force and effect.

Each of the undersigned is competent, of sound mind, and freely, voluntarily, and knowingly signs after reading the release and waiver of liability. No oral representations, statements, or inducements have been made.

Photo and Video Release

I hereby authorize OBYBSA to publish photographs and/or video taken of the registered participant(s) and his or her name for use in printed publications, social media, and the OBYBSA website.

I acknowledge that participation in publications, social media, and websites produced by OBYBSA is voluntary and that no financial compensation will be received. I further agree that participation confers no right of ownership whatsoever.

I release OBYBSA, its contractors, employees, staff, and coaches from liability for any claims by me or any third party connected with the use of these photographs or video.

Concussion Acknowledgment

OBYBSA provides concussion information to help parents and guardians understand the signs of concussion and the importance of removing a child from play when a possible concussion is suspected.
